A motorcyclist who is totally disabled as a result of a crash caused by a drunken driver will receive a $704,649 settlement from the insurer for a West Lafayette bar, according to court documents.
Christopher E. Harmon, 22, has been described as being in a waking coma as a result of a brain injury suffered in a crash on Sept. 2, 2004.
According to documents submitted in a guardianship case in Tippecanoe Circuit Court, the Harmons have agreed to accept a settlement with the Boston-based Lexington Insurance Co. under a $1 million liquor liability insurance policy issued to Jake's Roadhouse. In exchange, the Harmons would release Jake's from further liability.
The Harmons have alleged in a civil tort claim filed on Harmon's behalf that Nicole M. Fox, 24, of Lafayette had been drinking at Jake's the night before she drove left of center on County Road 350 South, causing three oncoming motorcyclists to crash.
