The Chain of Events on 350 South, Lafayette, IN
March 21, 1999


Will those in a position to change the “system” make the needed changes or are these events to be repeated again and again? 
Jeffrey Pedone Trout
•4 prior OWI arrests
•BAC .27 plus cocaine metabolites when killed on March 21, 1999
•Used 2 names and 2 social security numbers
•Arrested 19 times on 42 charges in 3 states
•After October 1998 OWI arrest, Boone County prosecutors negotiated an OWI plea-bargain but failed to check his probation status. Trout was on probation in Tippecanoe County for a prior OWI conviction at the time.

James Irwin

•Convicted habitual substance offender in 1995

•Convicted on 4 OWIs, 2 marijuana, and public indecency charges

•Claimed social security disability but was paid cash by Roger Heer

•Did not have a valid server's permit on March 21, 1999 (court deposition was not obtained until 5 days after the crash)

•Guilty of criminal recklessness April 13, 2000 180 days in jail and $1000 fine – maximum sentence allowed

Roger Heer
•Owner/operator of Mirage Nightclub
•Hired Irwin because Irwin was a "former" alcoholic
•Convicted on gambling charges in 1993
•Mirage was open 24 hours a day
•Operated video poker machines illegally
•Had minimal dram shop insurance even though Heer runs an insurance agency (Towerys and Smiths were required to pay the Mirage's legal bills)
•Renewal of liquor license denied on July 26, 1999.
•Paid cash to many Mirage employees to avoid taxes

Sarah Towery and Chip Smith

•Sarah, 24, and Chip, 20, were killed by a repeat drunk driver offender.

•Failure of the "system" also contributed to their deaths

 

Captain Morgan Rum
•Drink of choice by Jeffrey Trout on March 21, 1999
•Irwin served 10 drinks in 2 1/2 hours, all doubles with a splash; this is equivalent to 24 ounces of rum or almost an entire bottle.

Crash aftermath

•Chip, Sarah, and her parents were on 350 South heading for a hike in the woods on a Sunday afternoon. Sarah’s parents witnessed the death of their oldest daughter and her friend in their rearview mirrors.

•Sarah and Chip were wearing their seat belts, and their air bags deployed.
